Former immigration detainee befriended alleged Adelaide motel sexual assault victim, court documents reveal
A man accused of indecently assaulting a woman at an Adelaide motel less than a month after he was released from immigration detention befriended the victim before the alleged assault, according to court documents.
Aliyawar Yawari, 65, was arrested in December last year and charged with indecently assaulting a female guest at a motel in Pooraka.
Court documents obtained by the ABC reveal he befriended the victim before inviting her into his room and asking if she wanted a massage.
Police say the victim consented to the massage but the accused allegedly proceeded to sexually assault her despite her saying "no".
"The victim states the accused then tried to kiss her by moving his head forward, but she moved hers away so she wasn't able to," the court documents said.
Documents allege the victim ran back to her room and rang police and that she saw Mr Yawari kneeling in front of her door begging for forgiveness.
The documents said when police arrived they made enquiries with the Australian Border Force because the accused was wearing a home detention monitoring bracelet.
The alleged assault occurred three weeks after Mr Yawari was released from Yongah Hill Immigration Detention Centre in Western Australia.
Mr Yawari was released after the High Court of Australia ruled that indefinite detention was unlawful when there was no prospect of offenders being deported in the "reasonably foreseeable future".
On Friday at the Elizabeth Magistrates Court, Mr Yawari appeared via video link with the assistance of a Farsi interpreter.
His lawyer withdrew an ongoing application for his client's bail since there was no appropriate address for him to reside at.
The matter returns to court next week.
